This Privacy Policy explains how twerXout GmbH collects, uses, stores, discloses, and protects personal data when people use the website, create a Member account, access the Member Portal, buy products, attend events, join Instructor Training, submit Assessment Videos, or communicate with twerXout®.

2. Scope
This policy applies to website visitors, Members, Instructor Candidates, Licensed Instructors, event participants, purchasers, support contacts, newsletter subscribers, and other people who interact with twerXout®.
3. Personal Data We Process
Depending on how you use twerXout®, we may process:
- identity data, such as name, display name, account details, and profile information;
- contact data, such as email address, billing address, and communication details;
- account data, such as login status, session information, account preferences, language settings, and portal activity;
- purchase and billing data, such as product purchased, payment status, invoices, refunds, credits, billing profile, and Stripe customer references;
- access data, such as purchased products, Licensed Instructor status, licence-renewal status, and restricted-content access;
- learning data, such as content progress, favourites, Instructor Training progress, and Certification Review status;
- Assessment Video data, such as private videos submitted for Certification Review and related review notes;
- event data, such as Event Registration, Event Pass Holder information, program signup details, waitlist details, and attendance information;
- communication data, such as emails, support requests, form submissions, feedback, and administrative notes;
- technical data, such as IP address, browser type, device details, logs, security events, cookie identifiers, and usage data;
- marketing data, such as consent status, newsletter preferences, campaign interactions, and opt-out records.
We do not ordinarily collect date of birth for website use, Member account creation, or ordinary Member Portal access.
4. Purposes
We process personal data to:
- operate the website and Member Portal;
- create and manage Member accounts and sessions;
- provide digital content, video playback, and private content access;
- process checkout, payments, invoices, refunds, credits, and licence renewals;
- provide Instructor Training and Certification Review;
- manage Licensed Instructor status, Instructor Materials, licence renewal, and brand-use records;
- manage events, workshops, registrations, passes, programme signups, and waitlists;
- communicate with Members, purchasers, event participants, Instructor Candidates, and Licensed Instructors;
- provide support, security, fraud prevention, and abuse prevention;
- maintain business records, accounting records, and legal records;
- improve content, products, website quality, and user experience;
- send marketing communications where permitted and honour opt-outs;
- comply with legal obligations and enforce twerXout® terms and agreements.
5. Legal Bases
Where a legal basis is required, we rely on one or more of the following:
- performance of a contract or steps before entering a contract;
- legitimate interests, such as operating the website, securing accounts, preventing fraud, enforcing terms, improving services, and protecting the twerXout® brand;
- consent, such as optional marketing, optional cookies, optional public instructor profiles, testimonials, or certain media uses;
- legal obligations, such as accounting, tax, compliance, and recordkeeping duties;
- vital or safety interests where necessary in an urgent health or safety situation.
6. Assessment Videos and User Submissions
Assessment Videos are private submissions used for Certification Review and related administration or support. They are not public content, Instructor Materials, or marketing materials unless twerXout® separately requests and receives explicit permission.
Access is limited to people and service providers who need it for review, support, administration, storage, security, or legal compliance.
7. Cookies and Similar Technologies
We use cookies and similar technologies for necessary website functions, Member sessions, security, language settings, pricing context, checkout support, consent records, and, where enabled and permitted, optional analytics.

8. Service Providers and Other Recipients
We use service providers to operate twerXout®. Depending on the feature used, these may include:
- Railway for application hosting and infrastructure;
- PostgreSQL infrastructure for account, purchase, access, progress, event, and licence records;
- Stripe for payment processing, billing, invoices, refunds, and payment-fraud controls;
- Bunny.net for video hosting, secure playback, course media, and private Assessment Video storage;
- Resend and, where configured, Mailtrap for transactional email delivery;
- IPinfo for approximate location and pricing-context resolution;
- YouTube in privacy-enhanced mode where a page contains an embedded YouTube video;
- professional advisers and providers supporting accounting, tax, legal compliance, security, and incident response.
Service providers receive only the data reasonably needed for their role and process it under their own terms and the applicable contractual safeguards.
We may also disclose data where required by law, court order, authority request, legal claim, payment dispute, fraud investigation, safety issue, business transfer, or enforcement of our terms.
9. International Transfers
twerXout® is based in Switzerland and may use service providers or systems in Switzerland, the European Economic Area, the United Kingdom, the United States, or other countries.
Where required, we use appropriate safeguards for international transfers, such as adequacy decisions, contractual safeguards, data processing agreements, or other lawful transfer mechanisms.
10. Retention
We keep personal data only as long as needed for the purposes described in this policy, including account operation, content access, payment records, legal records, tax records, license records, dispute handling, fraud prevention, security, and contract enforcement.
Retention depends on the type of record:
- Member account data: for the life of the account and a reasonable period after closure;
- payment, invoice, tax, and accounting records: for legally required retention periods;
- licence and terms-acceptance records: while relevant to licence rights, renewal, enforcement, or disputes;
- Assessment Videos: for Certification Review and related support or audit needs, then deleted or archived under the applicable operational retention schedule;
- technical logs: for a limited security and diagnostics period unless needed longer for fraud, abuse, or legal reasons;
- marketing records: until opt-out or withdrawal, plus records needed to prove compliance.
11. Your Rights
Depending on your location and applicable law, you may have rights to:
- request access to your personal data;
- request correction;
- request deletion;
- request restriction of processing;
- object to processing;
- request data portability;
- withdraw consent where processing is based on consent;
- opt out of marketing;
- lodge a complaint with a competent data protection authority.

12. Security
We use reasonable technical and organizational measures to protect personal data against unauthorized access, loss, misuse, alteration, disclosure, or destruction.
No online service can guarantee absolute security. You are responsible for keeping your account credentials confidential and for using secure devices and networks.
13. Minors
twerXout® does not ordinarily collect date of birth for website use, Member account creation, or ordinary Member Portal access.
Instructor Training, Certification Review, Licensed Instructor status, and instructor licences are restricted to people who are at least 18 years old.
14. Marketing Communications
We may send marketing communications where permitted by law or consent. You can opt out using the unsubscribe link or by contacting us.
Operational messages, payment messages, account messages, legal notices, and service messages may still be sent where needed.
15. Changes to This Policy
We may update this Privacy Policy from time to time. The current version will show the effective date.
Material privacy changes may be communicated more prominently where appropriate.

Para seleccionar el precio según el país, la dirección IP pública visible para twerXout® se envía brevemente a IPinfo. twerXout® no conserva la dirección IP completa con este fin.
